Should I sue?

I was using a toothpick and got a splinter in my mouth. Grounds for a lawsuit?

You're in Florida, so i'd say yeah :-)

As my US attorney once said: "This is America. You dont need grounds to sue."

Kevin 06-11-2003 11:19 AM

I was going to ask what country you where in till I see your Florida title.... so yes If I was you I would sue.

You should get around 3 million for it, so diffenatly worth the go :)

no worse than the kid sueing because he misused a thermometer. wasn't his mouth...wasn't his nose...wasn't his ear... wasn't his butt.... but was definatly below the belt and he got it all the way in and it broke.

was the younger brother of my old highscool friend. i remember them trying to stop the bleeding.

dave_baer 06-11-2003 05:06 PM

Whew! Good thing he wasn't horny or he could have bled to death! :D

UUUHHHGGGHHHH!!!! Iron... Now thats sick...

Dave: dont forget to take photos of the harming splinter...:)

dave_baer 06-11-2003 07:02 PM

Well... seems that I wont have much of a case. I removed the splinter once it impaled itself in my cheek. (Instinctive reaction)

Wifey cleaned up this morning and now it's gone.

Looks like I don't get my 3 mil after all. :(

Break another toothpick into splinters, and claim that one of these new splinters was the culprit. Be sure to carefully wipe one end of it on the inside of your mouth so it has traces of saliva and skin cells on the end. You never know what kind of forensic experts the defence will have.

dave_baer 06-11-2003 08:47 PM

and blood! that would mean having to stab myself. and I already know how much it hurts. :\

iron_tick 06-11-2003 09:59 PM

try shoving the toothpick in your knob hole and claim that the toothpick company never stated that it couldnt be used for self exploration.

Oh and dont forget to break it off. get way up in there with it too, you want surgery. It increases the claim.

Witchy 06-11-2003 10:06 PM

There was a claim detailed in a recent American medical journal where a guy cut his leg off with a chainsaw (accidentally I assume) and then sued the chainsaw company for not printing a warning specifically cautioning against doing that.

Apparently you can now buy chainsaws in California which have 'do not use for human limb amputation', on the label; I am sure that will prevent more people doing it.

Overall therefore the toothpick thing stands a really good chance! Go go go! And can we have 10% of whatever you get for encouraging you?
