Default Layer Issue

So i finally decided to start something new again, and i am having the oddest problem with it.

i set my image planes up and put them on the layer, but when i set the layer to template or ref, for some reason it does not affect the image planes...when i turn the visibility off on the layer they planes behave as they are supposed to... I've deleted the layers and started again from scratch...have the same issue.
Also restarted Maya just in case it was some unexplainable glitch that gets fixed upon restart.
and i've deleted the prefs folder as well.
i have done everything short of setting up a new scene.

Any new suggestions?...

Are they true image planes attached to the cameras, or are they poly planes with image textures?
